چکیده

امروزه فضای مجازی بستر جدیدی برای تسهیل بسیاری از امور است به گونه‌ای که حتی در مواردی استفاده از امکانات این فضا لامحاله شناخته می‌شود. همان‌گونه که زندگی اجتماعی تابع مقرراتی است، حضور در عرصه مجازی نیز حقوق و تکالیفی ایجاد می‌کند. زنان به عنوان بخشی از افراد جامعه، بنا به ضرورت کاربر و یا مخاطب داده‌های فضای سایبر قرار گرفته و گاهی به دلیل تهیه، تولید و انتشار محتوای خلاف عفت عمومی و مغایر با اخلاق حسنه نقش بزه‌کار و یا بزه‌دیده را بر دوش می‌کنند. این پژوهش با تحلیلی مبتنی بر جنسیت کوشیده است هرزه‌نگاری را در رسانه اجتماعی اینستاگرام بررسی نماید. یافته‌ها نشان می‌دهد محتوای هرزه‌نگاری ایرانی و فارسی به سهولت در اختیار کاربران این بستر قرار می‌گیرد. با تحلیل محتوای تصویری و متنی پست‌های منتشرشده و هم‌چنین اظهارنظر کاربران دریافته می‌شود که گاهی مخاطبان نسبت به محتواهای نادرست و خلاف عفت واکنش عرفی نظیر سرزنش و یا عدم تأیید را نشان می‌دهند اما به نظر می‌رسد چنان‌که باید و شاید برخورد قانونی و مجازات مرتکبین انعکاس کافی نداشته و بازدارندگی لازم را در این بستر ایجاد نکرده است لذا تدوین و یا تقویت ضمانت اجراهای قوی‌تری در جرم‌انگاری و اجرای مجازات در خصوص آن ضرورت دارد.

چکیده [English]

Currently, the virtual space is a new platform that has facilitated many things in such a way that in some cases the use of the facilities of this space for interpersonal and group communication is inevitable and has caused continuous interactions with this tool. Just as living in the real world is subject to regulations, presence in the virtual arena also creates rights and duties. Women, as a part of the society, are the users or the audience of data in the cyberspace, and sometimes they play the role of criminals or victims due to the preparation, production and publication of content that violates public modesty and good morals. This research tries to investigate pornography on Instagram with a gender analysis. The findings show that the content of Iranian and Persian pornography is easily available to the users of this platform. Analyzing the visual and textual content of the published posts and examining the comments of users, it is found that the customary encounter with wrong behavior has taken place, but it seems that the legal treatment and punishment of the perpetrators have not been sufficiently reflected and the necessary deterrence has not been created in this context. Therefore, it is necessary to guarantee a stronger enforcement in criminalization and punishment.
